Abstract

In the world, trust management (trust) institution is widely used as the most convenient and widespread method of efficient and optimal use of investments, property, securities. In particular, trust management of investment, venture, and hedge funds is considered one of the effective methods for the economies of developed countries, and the services of professional managers are felt in many sectors. In this, it is necessary to determine the legal essence of the institution of trust management of property, to harmonize the rules of the application of this institution in Anglo-Saxon law with the continental legal system, to develop the trust management of investment and mutual funds, to clarify the legal status of the trust manager, to simplify the procedure for drawing up and formalizing a trust management contract, to the trust management of valuable securities analysis of the characteristics of transfer, determination of the trustee's responsibility, creation of legal bases for the activity of professional trustees, scientific research of the application of trust management in different legal systems, and creation of new innovative scientific developments are becoming important. In this article, the nature of the property trust management contract, which has a unique place in the system of civil legal contracts, is covered from the point of view of its development prospects. The author puts forward proposals for improving the national legislation on the trust management contract based on the basis of the formation of the institution of trust management in the system of foreign countries.
