Violation of Procedural Deadlines and Judicial Decision Stability in Civil Proceedings

Abstract

This article examines violations of procedural deadlines in civil proceedings and their impact on the effectiveness of judicial activity, stability of court decisions, and the realization of the principles of fairness and legal certainty. The relevance of the research is обусловлена persistent problems in judicial practice related to delays in case consideration, inconsistent restoration of missed deadlines, and uneven application of procedural rules. The study aims to identify the main causes of procedural deadline violations and to develop scientifically grounded proposals for improving procedural discipline. The research employs normative-legal analysis, comparative legal methods, examination of judicial practice, and doctrinal analysis. The article analyzes organizational, subjective, and legal factors contributing to deadline violations, with particular attention to judicial workload, participant behavior, and regulatory ambiguity. Comparative analysis of foreign legal systems, including Germany and the Netherlands, demonstrates effective mechanisms for ensuring procedural time discipline. Based on the findings, the article proposes measures such as digital monitoring of procedural deadlines, clarification of legal criteria for deadline restoration, optimization of judicial workload, and enhancement of responsibility for procedural abuses. The conclusions may be used to improve judicial practice and procedural legislation in civil justice systems.
