MECHANISMS OF STATE REGULATION OF ENTREPRENEURIAL ACTIVITIES IN THE CONSTRUCTION SECTOR: INSTITUTIONAL-LEGAL AND DIGITAL APPROACHES (ON THE EXAMPLE OF UZBEKISTAN)

Abstract

Entrepreneurship in the construction sector is a multiplicative sector that directly affects economic growth, infrastructure renewal and the quality of life of the population. However, the sector is characterized by high risks: technical safety, seismic stability, land and urban planning regimes, environmental impact, effective use of budget and private funds, corruption risks and a high probability of legal disputes. Therefore, the state regulatory mechanism is not only “prohibition and inspection”, but also a system of interrelated institutions such as risk-based administrative procedures, licensing and qualification requirements, technical regulation, transparent procurement, digital monitoring, ensuring public participation, and infrastructure for conciliation and dispute resolution. The article analyzes the current architecture of state regulation of construction entrepreneurship in Uzbekistan using the Urban Planning Code, the Law on Licensing and Permitting Procedures, the Presidential Decree on Improving State Control in the Construction and Housing and Communal Services, the Strategy for Modernizing the Sector, the National Information System "Transparent Construction" and its open registers, the "State Control in Construction" platform, electronic rating and electronic tendering tools. As a result, a conceptual model of regulatory mechanisms along four contours "legal-institutional-digital-economic" is proposed, and recommendations are outlined for its implementation, based on risk-proportionate control, standardized contracts, full digitization of document flow, and data integration.
