Issues of Regulation of Contracts Arising from Sports Relations by Sub-Statutory Norms

The article gives an insight into the nature of norms of by-laws along with their role in regulating sports contracts flowing from sports relations. The notion of normative legal acts has been elaborated; various normative legal acts issued by a range of state bodies are distinguished and considered in different sports contexts. The competence of local self-governing bodies in the field of physical culture and sports and their interaction with private businesses in the sphere of sports relations has been assessed. Potential for cooperation between state bodies and private businesses in the establishment of sports facilities and accessible infrastructure has been explored. In this regard, foreign experience in the provision of sports services as a form of public utility function and ensuring the beneficial partnership between public and private sectors is taken into account. Further, the interrelation of the legislation in the area with other branches of law is considered. The procedure for engaging coaches and foreign sports specialists in sports training and the terms of their contracts has been analyzed drawing on issues present in this area. The article goes on to examine and call for revision of the norms of by-laws regulating conclusion of contracts with the regular members of the sports teams. Finally, the norms governing the conclusion of contracts with sports referees are assessed through the prism of foreign legislation provisions. Issues of the establishment of sports clubs rendering paid services in state educational institutions are discussed.
