The Role and Importance of The Judicial Manager Institute in Resolving Insolvency Cases in Economic Courts: A Comparative Perspective

This article provides a comprehensive analysis of the legal and procedural status of the Judicial Manager within the insolvency framework of the Republic of Uzbekistan’s economic court system. The study explores the dual nature of the Judicial Manager as both an officer of the court and a professional fiduciary, emphasizing their pivotal role in balancing the interests of debtors and creditors. By conducting a comparative legal analysis with the insolvency regimes of Germany, the United Kingdom, and the United States, the author identifies key areas for systemic improvement. The research argues for the transition toward a self-regulatory model and the introduction of advanced mechanisms such as tiered professional indemnity insurance and digital predictive monitoring. The article concludes that strengthening the procedural independence and liability of the Judicial Manager is essential for enhancing the investment climate and ensuring the stability of the national market economy.
