Criminal Law Analysis OF Fraud Committed in Cyberspace
Аннотация
This article examines the crime of fraud committed in cyberspace in the context of digital transformation from a criminal law perspective. The scientific novelty of the article lies in the fact that, for the first time within Uzbekistan's criminal law system, cyber fraud is substantiated as an independent category of crime, and it is demonstrated that the four elements of the corpus delicti acquire distinct content in the cyberspace environment. Normative legal gaps in national legislation are identified; specific proposals for their elimination are developed on the basis of the Budapest Convention and the experience of Germany, the United States, and the Russian Federation. The article also provides a comparative analysis of the principal scholarly debates in cyber fraud doctrine.
