ORGANIZATION OF COLLECTION AND REMOVAL OF SOLID HOUSEHOLD WASTE ILLEGALLY PLACED ON THE TERRITORY OF THE FOREST FUND: REVIEW OF JUDICIAL AND ARBITRATION PRACTICE

The article deals with judicial arbitration practice on disputes related to the organization of collection and removal of solid household waste illegally placed on the territory of the forest fund. It is noted that the courts make decisions on the liquidation of such landfills at the expense of subventions provided from the federal budget to the budgets of the constituent entities of the Russian Federation for the exercise of delegated powers in the field of forest relations, which leads to a significant diversion of financial resources for purposes unrelated to the field of forest relations. This is a consequence of legislative gaps that need to be addressed by amending the Forest Code of the Russian Federation.
