Constitutional and Legal Bases of Inter-Level Interaction of Local Public Authorities in the Republic of Uzbekistan

Аннотация

Using the example of legal regulation and law enforcement practice of the Republic of Uzbekistan, the article examines the problems of optimizing and achieving a balance of inter—level interaction of public authorities, the result of which should be, on the one hand, ensuring the execution of acts of higher authorities by lower authorities, and on the other hand, preventing unjustified and inappropriate vertical interference in the activities of lower authorities. The purpose of the study is to develop conceptual approaches to achieve a vertical balance of interests of the levels of government to ensure maximum disclosure of the managerial potential of each level of government in solving national tasks. Research objectives: analysis of theoretical, legal and law enforcement aspects of the features of vertical relations between levels of government built in Uzbekistan, identification of relevant problems and development of recommendations for their solution. Research methods: formal-legal, comparative-legal, functional, logical, system-structural methods. Results and brief conclusions. The system of relations between the levels of government should be built on the basis of the concept of autonomy of the status of each government level, which implies, in the institutional aspect, the establishment for each of them of the possibility of forming their own governing authorities, and in the functional aspect — the possession of their own exclusive powers, in which higher authorities have no right to interfere. The rights of subordinate authorities should not be protected administratively by repealing the acts of subordinate authorities by higher authorities, but by judicial mechanisms. At the same time, higher authorities should have the necessary and sufficient powers to retain lower authorities within the framework of national interests and in the legal field. Thus, each level of government will be autonomous within its exclusive powers, while being under the strict and close supervision of higher authorities. Such a construction of power relations will allow maximizing the creative managerial potential of each level of power.
