Adaptive Regulation, Sandboxes, and Experimentalist Approaches

The rapid proliferation of artificial intelligence technologies presents unprecedented challenges to traditional regulatory frameworks and democratic governance structures. This chapter examines how adaptive regulation, regulatory sandboxes, and experimentalist governance approaches are reshaping the social contract between citizens, governments, and technology corporations in the AI era. Through comprehensive analysis of emerging regulatory models across multiple jurisdictions, this study demonstrates how experimentalist approaches enable responsive governance while maintaining democratic accountability. The chapter evaluates the effectiveness of regulatory sandboxes in balancing innovation with risk management, explores the theoretical foundations of adaptive regulation in complex technological environments, and proposes a reconceptualized framework for the social contract that accommodates algorithmic decision-making while preserving fundamental rights.
