The collection of "Fatawa al-Kabiri" fatwas of the Mongolian period and its copies in the funds of the Abu Rayhan Biruniy Institute of Oriental Studies, Uzbekistan Academy of Sciences

"“Fatawa al-Kabiri” (“Legal Opinions of al-Kabiri”) is a collection of fatwas that was created by Kabir ibn Kabir al-Dizaki al-Samarqandi (14th century), a prominent Islamic scholar in Central Asia during the Mongol period. There are several transcripts of this collection preserved at the Abu Rayhon Biruniy Institute of Oriental Studies, the Academy of Sciences of the Republic of Uzbekistan. These transcripts have not been found in any other manuscript libraries. Firstly, we should focus on the structural and thematic arrangement of the collection. This manuscript consists of a series of questions and answers structurally. In addition, the author’s preface describes the general sociopolitical and religious situation in and around Samarkand after the Mongol conquest. It can be revealed that the manuscript does not contain some topics, which were an integral part of traditional works on Hanafi fiqh in the earlier period. As a result of the tabular comparison of legal issues (al-masa'il al-fiqhiyya) presented in each of the thematic sections of the analyzed transcripts of this collection, their distinctive features are determined. It is shown that there is no presumption of the text about each other. There are more than fifty works quoted by the author of “Fatawa al-Kabiri”, the overwhelming majority of which belong to the local Hanafi school of law. The four transcripts of “Fatawa al-Kabiri” preserved at the Abu Rayhon Biruniy Institute of Oriental Studies are now available to scholars. The volumes (jild/majmu’a) of transcripts are not independent, other works are also included. Thus, “Fatawa al-Kabiri” can serve as a “mini-library” for its users, such as a jurisconsult (mufti), a judge (qadi), a madrasa teacher (mudarris) and a student (talib al-’ilm)"
